1. Definitions<\/strong><\/p>\n Paris en Bateau is the trading name under which the company Paris en Bateau SAS conducts its business as a provider of private river cruises.<\/p>\n 2. General provisions<\/strong><\/p>\n The provision of services aboard vessels, whether underway or berthed, and associated services, particularly catering and entertainment, is subject to the provisions of these general terms and conditions of sale, which shall take precedence over any general terms and conditions of purchase, the latter in no way being enforceable against Paris en Bateau.<\/p>\n Any order, reservation, or purchase of a service implies full acceptance of these general terms and conditions of sale.<\/p>\n 3. Booking conditions<\/strong><\/p>\n The contract for the provision of services on vessels at sea or in port, and associated services, shall be deemed to have been concluded and the customer bound upon receipt by Paris en Bateau of its quotation or purchase order, duly signed and dated by the customer and accompanied bya deposit cheque for 50% of the total amount (including VAT) of the quotation, all subject to clearance. Should the cheque not be cleared, the contract shall automatically become void, without prejudice to Paris en Bateau\u2019s rights to claim damages.<\/p>\n The final number of participants will be communicated by the client to Paris en Bateau no later than 10 days before the service. In the event of an overrun not covered by a written amendment from Paris en Bateau, and subject to available places according to the announced capacity of the boat, the non-admission of additional passengers\/participants does not constitute grounds for cancellation of the order. The price of the service will not be reduced in the event of fewer passengers\/participants compared to the final number of passengers\/participants.<\/p>\n 4. Cancellation<\/strong><\/p>\n At the client's request<\/u>\u00a0:<\/p>\n Due to the provider<\/u>\u00a0:<\/p>\n As cruises are subject to navigation rules, the shipowner reserves the right to determine the navigability of the river. Cruises may be cancelled or modified at any time from booking, including on the scheduled departure day, in accordance with the aforementioned rules, or in the event of adverse weather conditions that could jeopardise the safety of the passengers.<\/p>\n In cases of force majeure or legitimate causes: floods, public disorder, strikes, technical or mechanical incidents\u2026 cancellations and modifications will not result in payment of a<\/p>\n any compensation to the customer. Boarding at a different quay than the one booked will not result in a refund.<\/p>\n 5. Payment<\/strong><\/p>\n The deposit paid constitutes an initial payment which is part of the price of the service provided. The balance of the price of the service must be paid 8 days before the service. Any supplements will be subject to an additional invoice, payable on receipt.<\/p>\n Any late payment shall automatically and without formality result in the charging of late payment interest calculated on the principal amount excluding tax due, at a rate equal to one and a half times the legal interest rate in force on the date of the order, applied from the first day of delay.<\/p>\n 6. Cruise and boat access regulation<\/strong><\/p>\n Paris en Bateau will make every effort to ensure the service is provided in accordance with the terms of the accepted booking. However, Paris en Bateau cannot, under any circumstances, be held responsible for the payment of compensation in the event of changes to departure or return times of less than one hour, changes to the route, or delays due to navigation difficulties, bad weather, actions of participants\/passengers (delays, illness, etc.), or in cases of force majeure, or failure to comply with instructions given by the river authorities.<\/p>\n \u00a0<\/strong>Passengers\/participants will have the following obligations:<\/p>\n \u2013 On board, each passenger\/participant must comply with the instructions of the boat's crew.<\/p>\n No dangerous materials will be allowed on board.<\/p>\n \u2013 No animals will be admitted on board.<\/p>\n - Paris en Bateau shall not be held liable in any way for theft or damage to clothing, luggage or other belongings.<\/p>\n Paris en Bateau reserves the right to charge passengers\/participants for any damage or destruction caused by them.<\/p>\n \u2013 Access to the cockpit, galleys and machinery spaces is strictly forbidden.<\/p>\n \u2013 The client and passengers will proceed to the upper decks, or any open-air areas of the boat, at their own risk and expressly waive all recourse against the provider for any material, physical or intangible damages resulting from the actions of third parties or from materials external to the boat.<\/p>\n The service provider shall not be held liable for damage caused to vehicles or their contents, parked in car parks or on open ground adjacent to the designated boarding area, nor for losses or damage incurred by the client in boarding or parking areas or any other public domain.<\/p>\n \u2013 <\/strong>The client undertakes to comply with and to ensure compliance with all legislation in force, particularly regarding the consumption of alcohol, as well as the distribution of alcohol, especially to minors. The client is solely and uniquely responsible for the distribution of alcohol ordered. Under no circumstances shall the responsibility of PARIS EN BATEAU be sought regarding any consequences directly or indirectly related to the distribution or consumption of this alcohol.<\/p>\n 7. Punctuality<\/strong><\/p>\n For non-private cruises, passengers, or the entire group, must present themselves at the designated boarding point no later than 5 minutes before the scheduled departure time. If a passenger arrives after the boat has departed, they will not be entitled to any refund. For private cruises: the provider reserves the right to reduce the cruise time by an amount equivalent to the delay incurred by the client(s) at boarding.<\/p>\n 8. Prices<\/strong><\/p>\n The prices are shown in euros.<\/p>\n The prices confirmed on the quotation are firm for 15 days from the date the quotation is sent to the clients. After this period, they are subject to change.<\/p>\n No discount is given for cash payment.<\/p>\n 9. Artistic outdoor animation<\/strong><\/p>\n The events are organised by Paris en Bateau. By way of exception, if the client wishes to organise this part of the service themselves, they agree to provide Paris en Bateau with the following documents upon request:<\/p>\n \u2013 quote or invoice from the service provider or prior employment declaration for artists,<\/p>\n \u2013 Certificate of valid professional liability insurance.<\/p>\n \u2013 justify the declaration made to SACEM and the payment.<\/p>\n If these documents cannot be provided at least 5 working days before the performance, providers or artists will be denied access.<\/p>\n 10. Conventional Mediation<\/strong><\/p>\n PARIS EN BATEAU informs the client that they may resort to conventional mediation, in particular with the consumer mediation commission or with existing sectoral mediation bodies, or to any alternative dispute resolution method in the event of a dispute. When a mediator is appointed for the PARIS EN BATEAU activity, the company undertakes to communicate the mediator's contact details to the client.<\/p>\n 11. Jurisdiction<\/strong><\/p>\n In the event of a dispute or disagreement, the courts of Paris shall have exclusive jurisdiction; disputes arising with our professional clients shall fall under the sole jurisdiction of the Paris Commercial Court, even in the case of a claim for indemnity, if there are multiple defendants and regardless of the method and terms of payment.<\/p>\n Paris en Bateau nevertheless retains the right to bring the matter before the competent court for the defendant's domicile.<\/p>\n 12.
